Terms of Service

Effective 14 October 2026 · Version 2026-10-14

The short version. The Garden is a free browser game. You can play without an account. If you choose to save your gardens to your email, you need to be 13 or older and accept these terms. Accepting them also signs you up for news and offers from us by email, which you can turn off at any time. Be kind to other gardeners.

1. Who we are

The Garden (at thegarden.wtf) is run by 240yrolds (“we”, “us”). You can reach us at [email protected]. These terms are an agreement between you and us about using The Garden.

2. Playing The Garden

You can play The Garden in your browser without an account. Your progress is kept on our servers and remembered by your browser. You can start a garden, explore alone, or join other gardeners’ gardens with a code or from the list of open lobbies.

Gardens are shared spaces. Anyone with a garden’s code (or, for a public garden, anyone on the lobby list) can join it, up to four gardeners at a time. A private garden asks for the password its creator set.

3. Optional accounts

You can save your gardens to your email address, so you can carry on from any browser. There is no password: we email you a link that signs you in. The link works once, for a short time.

4. Emails from us, including news and offers

By creating an account and accepting these terms, you agree that we may send you:

You can stop news and offers at any time, without closing your account: use the unsubscribe link in any such email, or untick “Email me news and offers” when signed in. Service emails will still come when you need them, for example when you ask for a sign-in link.

5. How to behave

The Garden is for everyone. When you play, you agree not to:

We may remove content, end sessions, or suspend or delete accounts that break these rules, at our discretion.

6. Voice chat

Proximity voice chat is off until you turn it on and allow your microphone. Other gardeners near you in a garden can hear you. We do not record voice chat. Please don’t share personal information over voice, and leave voice off if you are not comfortable being heard.

7. What you make

Things you build or name in The Garden stay yours. You give us a worldwide, free licence to host, store, copy and show them, inside The Garden and when we share or promote The Garden, for as long as they are in the game. You promise you have the right to anything you add.

The Garden itself (its software, art, sounds and names) belongs to us and our licensors. You may share screenshots and videos of your play.

8. The game changes

The Garden is a work in progress. We may add, change or remove features, lands and items, reset or remove gardens (for example gardens nobody has played for a while), and pause or end the service. We try to keep your gardens, but we can’t promise that any garden, item or progress will be kept forever.

9. No warranty

The Garden is provided “as is” and “as available”, free of charge, without warranties of any kind, to the fullest extent the law allows. We don’t promise it will always be available, secure or free of bugs.

10. Limits on our liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost data or progress, arising from your use of The Garden. Our total liability to you for any claim is limited to USD $50. Nothing in these terms limits liability that cannot be limited by law.

11. Ending things

You can stop playing and delete your account at any time. We may suspend or end your access if you break these terms or if we stop running The Garden. Sections 7 to 10 and 13 continue after your access ends.

12. Changes to these terms

We may update these terms. We will change the date at the top, and for important changes we will let account holders know, for example by email or when they next sign in. If you keep playing after the change, the new terms apply.

13. Governing law

These terms are governed by the laws of the place where 240yrolds is established, except where the law of the country you live in says otherwise. Its courts will hear any disputes, unless your local law gives you the right to go to court where you live.
